Emergency FMLA and paid sick leave due to COVID-19

On March 18, 2020, President Trump signed the Families First Coronavirus Response Act (FFCRA), which became effective today, April 1, 2020.

The Act includes Emergency Paid Sick Leave and Emergency Family and Medical Leave to mitigate the economic and public health consequences of COVID-19. Employees may be eligible for up to two weeks of fully or partially paid (i.e., depending on reason for leave and/or use of leave balances) sick leave for certain COVID-19 related reasons (see attached flyer).

Employees who have been employed for at least 30 days prior to their leave request may be eligible for up to 12 weeks of fully or partially paid (i.e., depending on use of leave balances) family and medical leave to care for his/her child whose school or place of care is closed due to COVID-19 related reasons. 

Emergency responders are generally not eligible for leave due to child’s school closure or child care provider unavailable due to COVID-19, but requests will be considered on a case-by-case basis.  The Act is effective through December 31, 2020.

To the extent work is available or you are able to telework while caring for your child(ren), paid sick leave and expanded family and medical leave is not available.  If you are unable to work (or telework) for a qualifying reason related to COVID-19 you may be eligible for paid leave benefits included in the Families First Coronavirus Response Act.
